General Terms and Conditions (GTC)

1. Purpose

These General Sales Conditions (GSC) govern the contractual relationship between the company A TALE OF FACTSSARL au capital de 200 €, located at 14, avenue Carnot, 75017 Paris, France, email : [email protected]hereinafter referred to as "the Vendor", and any individual or legal entity wishing to make a purchase via the site https://www.contedefaits.comhereinafter referred to as "the Customer".

Any order placed on the site implies full acceptance of these GTC by the Customer.

2. Pre-launch

The site is entering its pre-launch from Tuesday, July 15, 2025in preparation for the official launch scheduled for early September 2025.

During this summer period, some orders may experience production or delivery delays. Our partner printer based in Nantes is also affected by reduced activity during the summer.

Nevertheless, we are committed to maintaining an attentive customer service, and to taking into account all feedback from our first customers in order to continually improve the quality of our services.

3. Products on offer

Conte de Faits designs and sells :

• Personalized children's books, printed on demand using data supplied by the customer (first name, gender, age, messages, images, etc.).
• Customized digital products (PDF versions, audiobooks, interactive files)
• Subscription formulas or recurring services, in development
• Digital gift cards that can be used to purchase any of the above products

Each product is unique and custom-made. It cannot therefore give rise to a standard right of withdrawal (see article 8).

4. Control

4.1 Ordering process

The customer personalizes a book via an interactive form, then validates the content before proceeding to payment. A confirmation email is then sent.

In the case of a gift card, it is automatically sent by email to the beneficiary, with the personalized message entered by the purchaser. The customer is responsible for the email address entered.

The customer is solely responsible for the data entered (first names, spelling, photos, etc.).

4.2 Validation and rejection

The Seller reserves the right to refuse an order in the event of inappropriate content, suspected fraud or non-compliance with the GTC.

5. Rates and payment

5.1 Prices

Prices are given in euros and include VAT. Delivery charges are specified at the time of order.

5.2 Terms of payment

Payment is made online via secure service providers (e.g. Stripe, PayPal). Bank details are never stored by Conte de Faits.

6. Delivery

6.1 Deadlines

• Production: 3 to 7 working days
• Delivery in France: 3 to 7 working days after production
• International delivery: according to destination

Delivery times are indicative. No reimbursement will be made in the event of a delay caused by a third party (printer, carrier, etc.).

6.2 Delivery methods

Delivery by La Poste, Colissimo or partner carriers. Charges are calculated automatically according to weight and destination.

7. Digital products and access

Digital products are delivered by secure link or from the customer area. They are not physically shipped.

In the case of a gift card, the code is sent directly by email to the beneficiary, and can be used at any time within the limit of its validity (12 months).

8. Right of withdrawal

8.1 Customized products

In accordance with article L221-28 of the French Consumer Code, no right of withdrawal applies to personalized products.

8.2 Digital products

For content delivered immediately, the customer waives his right of withdrawal at the time of payment.

9. Receipt and complaints

All books are printed in France by our partner in Nantes and checked before dispatch.

The customer must check the condition of the parcel on receipt. In the event of a defect or obvious error, a complaint must be made within 24 hours to [email protected].

Products must be handled with care. No refund will be given for post-receipt deterioration due to improper handling (e.g. page torn off by a child).

10. Legal warranties

The Seller applies the warranties of conformity and against hidden defects in accordance with Articles L217-4 to L217-14 of the French Consumer Code and Articles 1641 to 1649 of the French Civil Code.

12. Intellectual property

All content (text, images, code, AI, etc.) is the property of CONTE DE FAITS. Any unauthorized reproduction or adaptation is prohibited.

13. Liability

Conte de Faits cannot be held responsible:

• Errors in the data entered by the Customer
• Inappropriate use of the product
• Delays caused by a third party
• Inability to access a digital product (incorrect email, incompatible device, etc.)

14. Force majeure

The Seller cannot be held responsible in the event of force majeure (strike, pandemic, fire, etc.).

15. Applicable law and disputes

These terms and conditions are governed by French law. In the event of a dispute, an amicable solution will be sought. Failing this, the Paris courts shall have sole jurisdiction.

16. Digital gift cards

16.1 Description

Conte de Faits gift cards are digital products, sent exclusively by email to the recipient, with a personalized message entered by the purchaser. They are not sent physically.

Each card contains a unique code, which can be used as a means of payment on the https://www.contedefaits.com within the limits of its validity.

16.2 Operation and conditions of use

• The gift card code is valid 12 months from date of purchase.
• It can be used in one or more instalments, until the balance is used up.
• It applies to all personalized books, including digital formats.
• He cannot be used to pay for postage or to purchase other gift cards.
• It is cumulative with other discounts (e.g. newsletter subscriptions, one-off promotions).

16.3 Shipment and liability

The gift card is automatically sent by email to the address entered by the customer at the time of ordering.

The customer is solely responsible for the accuracy of the recipient's address. No return can be guaranteed in the event of an error.

16.4 Automatic recall

If the card has not been used after six months, a reminder email is automatically sent to the beneficiary halfway through the validity period.

16.5 Loss, transfer or use

• The code is personal, confidential and non-transferable.
• It can be used by anyone in possession of the code, but cannot be reissued or cancelled.
• In the event of loss or fraudulent use, no compensation can be claimed.

16.6 No right of withdrawal

In accordance with article L221-28 of the French Consumer Code, gift cards are personalized digital products with immediate activation. As such, they may not be the subject of any right of retraction, refund or exchange.

16.7 Personal data
